@danepps My own view: There should be no border search exception allowing the search of a citizen's devices without a warrant, as I argued in my book. You can read the chapter at this link. https://t.co/MlHs3klkic 56K views · 1.1K likes · 30 reposts · 8 replies Open on X →

@danepps @OrinKerr Shocking, how many Americans are fine with losing their constitutional rights at the border. Either you haver rights or you don't. A search requires a warrant, period. There is no exception for CBP in your constitution. 32.1K views · 715 likes · 9 reposts · 14 replies Open on X →

@danepps @OrinKerr the bigger issue really is that it’s insane we’ve normalized this device raiding in the first place. 22.6K views · 631 likes · 1 reposts · 3 replies Open on X →

If true, and especially if this is becoming routine, very troubling. Curious what lawyers/law profs would do in this situation. SCOTUS has never weighed in on this practice. Thoughts, @OrinKerr, others? https://t.co/KRDRWa5N7k https://t.co/tDWQUMy0Yc

As criminal defense attorneys, public defenders have an ethical obligation to make every plausible argument that could help their clients avoid conviction or punishment, not just ones that seem attractive as a policy matter. This criticism makes no sense. 32.1K views · 518 likes · 41 reposts · 11 replies Open on X →

I don't know if the claim that Pangram detects AI reliably at present is true, but if so it reminds me a little of plagiarism software: There's some number of authors who assumed at the time of publication that no one could detect it, but at some future point, they could. 20K views · 46 likes · 0 reposts · 5 replies Open on X →

@danepps I’ve always thought that if I’d personally witnessed Souter’s eating an apple core, I would indeed have felt profoundly uneasy, and probs would have been minded to contact the authorities, tbh, so this v much tracks. 3.7K views · 11 likes · 2 reposts · 0 replies Open on X →
