NEW: Judge Indira Talwani issues a 49-page preliminary injunction opinion indefinitely blocking implementation of the USPS mail ballot rule for this election cycle. Theoretically, this moots the USPS's existing SCOTUS application, which is aimed at her prior temporary restraining

@lawofruby These judges, not the trump judges, are the most frustrating. Because in assuming, time after time, the most benign interpretation and good faith of Trump’s actions, they apply technicalities in a way that does a grave disservice to the law and the American people.

And then DOJ further argues -- noting President Kennedy's selection of his brother as his attorney general, which predates post-Watergate reforms and norms -- that "as a matter of historical analysis," DOJ's purported independence "is a myth." 4/

“The purported 'independence' of DOJ that Comey cites is antithetical to the constitutional separation of powers (which lodges the Executive power in the President alone)." 3/

It argues that even if there were evidence that Trump had ordered Blanche or the relevant US Attorney to indict Comey, “the Chief Executive directing his subordinates to exercise core Executive functions is a feature, not a bug, of our constitutional system.” 2/

NEW: A 9th Circuit panel unanimously upholds the disqualification of Nevada's acting U.S. Attorney Sigal Chattah. But its reasoning likely applies to Bill Essayli, who was appointed First Assistant U.S. Attorney after his own acting tenure ran out. 1/
