Yes, insanity is usually an affirmative defense (meaning the defense must convince jurors). In Massachusetts, prosecutors must prove it past reasonable doubt. So if the defense puts up a half decent expert jurors may say, the experts couldn't agree, reasonable doubt. Awful rule
