Yes, absurd. But that’s why Meta Comms seems to always pick Alex Heath for these. It’s embarrassing all around. Zuckerberg’s Meta drops billions so he doesn’t have to answer under oath on the stand about harms and his decisions then they trade access to lock in their narrative.

While we were on a holiday weekend, NYT nailed its motion for summary judgment on Friday. In NYT v. OpenAI/Microsoft -> the issue is substitution. And as SCOTUS noted, substitution is "copyright’s bête noire.” 1/2

Yes that issue is a prisoners' dilemma: AI companies are better off if quality journalism isn't harmed but each gains if they can take for free while others pay. Plaintiffs argue a ruling this isn't fair use will put all AI firms on an even footing. [a MSFT doc] "shows why." /11

Counter to Big AI proxies' spin, fair use is an affirmative defense. OpenAI/Microsoft have the burden to show no harm to existing (or potential!) markets. Plaintiffs show lots of harm. Looks like a MSFT exec even rightly tied this imperiling publishers to impacting AI itself. /10

Plaintiffs also allege OpenAI acquired content through Common Crawl sidestepping opt-outs (not that those are necessary) and publisher terms at unprecedented scale. We've been here but technically accessible is not the same as consent...even more so if working around blocks. /8 h

ok, I've now read the full NYT complaint filed this morning vs OpenAI and Microsoft. I'm impressed - it's future-focused around fair value for work vital to democracy. It also contains 220k pages of exhibits although the pages of Ex J stood out to me. more on that in a minute. /1
