Yes that issue is a prisoners' dilemma: AI companies are better off if quality journalism isn't harmed but each gains if they can take for free while others pay. Plaintiffs argue a ruling this isn't fair use will put all AI firms on an even footing. [a MSFT doc] "shows why." /11

Counter to Big AI proxies' spin, fair use is an affirmative defense. OpenAI/Microsoft have the burden to show no harm to existing (or potential!) markets. Plaintiffs show lots of harm. Looks like a MSFT exec even rightly tied this imperiling publishers to impacting AI itself. /10
