Last week, we filed an amicus brief in a Massachusetts Supreme Judicial Court carry permit denial case. Today, we have filed a very similar brief in a New Jersey Firearm Purchaser Identification Card (FPIC) denial case. FPICs are required to possess a firearm in New Jersey. https

@2AFDN I can't imagine the decision being anything less than 6-3
If course it ought to be 9-0
But there is no way Roberts or scaredy Barrett will be able to waffle here
Still disappointed that it has taken this long

Overall, a very strong brief and one which the Court will no doubt find persuasive, even if we will of course disagree on a few points in the analysis.
Thanks to @AAGDhillon, @Arrinba3870, and the rest of the DOJ team for the support. https://t.co/sEG1Jxpbul

Don't love this portion, but it isn't surprising. They still are expected to defend federal laws like the machinegun ban. https://t.co/xXS1Nt0VdH

AR-15s were originally developed for the military, sure, but so were wristwatches and duct tape! https://t.co/NcgXnYybEg

The lawful purposes USDOJ identifies:
Self-defense, defense of the nation, defense of the community, training, and hunting. https://t.co/8kiSiupDut

USDOJ argues that AR15s are useful for self-defense, but regardless, the test is any lawful purpose, not just personal self-defense.

USDOJ argues that while statistics are not necessary, they too prove AR15 commonality. Cites English, NSSF, Washington Post. https://t.co/zOOHN22tfr

Applying their form of the common use test to AR15s, the USDOJ concludes banning them is unconstitutional because they are legal federally, and in all but a handful of states with bans. https://t.co/mi0oztR1G0

To their credit, they acknowledge that this could be a problem for preemptively banned new arms, and they offer a differing analysis in that scenario so they can't just have the "one weird trick" method of constitutionality by quickly banning stuff before it has a chance to https

Questionable whether legislative actions should really counter the choices of the People. E.g., if otherwise law-abiding people acquire and peaceably keep certain arms in great numbers, even in defiance of laws banning them, why should that popularity be voided by the existence h

100% agree.
Anger at the common use test is actually anger at the Second Amendment's existence. What these courts are actually upset about is the idea that the People have a right to bear arms that the government may not infringe. That right would be an empty one if government

Citing Robert Leider, USDOJ argues that history proves that rifles are the quintessential protected arm and were never banned historically, in contrast to other things like Bowie knives and brass knuckles, for which some restrictions existed. https://t.co/cq6OivVs6l

The USDOJ expressly rejects the arguments about "militaristic" weapons. At the founding, there was no distinction. https://t.co/FcA6lYNM3F

The USDOJ has to manage a bit of a balancing act, assisting us in this case while not torpedoing its ongoing defense of federal laws.
They accomplish here by arguing common use can be a measure of whether or not "Congress and a significant majority of the State have long banned

The United States argues that because AR-15s are "unquestionably in common use among law-abiding citizens for lawful purposes," a ban on them violates the Second Amendment. https://t.co/IeEwdBCzQB

We are of course very grateful to all of the many groups and people who have submitted amicus briefs in our support today, about 40 in total (and more may still arrive before the day is done).
But the brief from the United States warrants special attention, so a thread now on
